Conservative Republican Roy Ashburn, a 55-year old father of four, has voted against gay initiatives including anti-discrimination laws, moves to recognise out of state same-sex marriages and even a bill to establish a day honouring murdered gay rights politician Harvey Milk.
Ashburn was arrested last week for driving under the influence of alcohol. He was then rumoured to have been at a gay nightclub earlier that evening and was driving in the company of an unidentified man.
Ashburn's California Senate term ends later this year and he says he will no longer stand for public office.
